On April 28, 2020, the U.S. Patent and Trademark Office announced that it was further extending the time to file certain patent and trademark-related documents and to pay certain required fees. The waiver applies to filings due between March 27, 2020 and May 31, 2020.  For patents, the deadlines that may be eligible for a wavier include: replies to office actions; issue fee payments; and maintenance fee payments by small or micro entities.  For trademarks, the deadlines that may be eligible include: responses to an office action; filing of statements of use; and requests for extensions to file a statement of use.  The USPTO further continues to provide relief in the form of a waiver of the petition fee for the revival of applications or trademark registrations that become abandoned on or before May 31, 2020, as a result of the COVID-19 outbreak. To seek relief under this wavier, a statement that the delay in a filing or a fee payment was due to the COVID-19 outbreak.
